What data we receive
- When you contact us on WhatsApp, by email or by video call: your name, the phone number or email address you wrote from, your company name, the address of your website or Instagram and anything else you choose to send us, such as copy, a logo and photos.
- When you browse the website: the server logs technical data for each visit, such as the IP address, the date and time, the page requested and the browser used. This happens on any website and serves the security and operation of the pages.
- What we don't collect: the website has no forms, asks for no sign-up or password and uses no advertising, analytics or tracking cookies. We also don't ask for sensitive data, such as health information, religion or biometrics.
What we use it for
- Replying to your message and understanding what your company needs.
- Preparing the free homepage preview and the quote.
- Building, publishing and maintaining the contracted website and providing the agreed support.
- Issuing invoices and meeting our other legal obligations.
- Protecting the website against abusive access and keeping the access logs required by law.
Your data is not used for any other purpose without notice to you and, where the law requires it, without your authorization.
Our legal basis
The LGPD only allows personal data to be processed in the cases listed in its Article 7. The ones Elemento relies on are:
- Contract and the steps before it (item V): to answer your request and to prepare the preview, the quote and the contracted project.
- Legal obligation (item II): to issue invoices and keep access logs for the period required by the Marco Civil da Internet (Law No. 12,965/2014), Brazil's Internet Civil Framework.
- Legitimate interest (item IX): for website security and the history of our service, always respecting your rights and freedoms.
- Regular exercise of rights (item VI): if we need to defend ourselves in judicial, administrative or arbitration proceedings.
Who we share it with
- WhatsApp (Meta), when you choose to talk to us there. The conversation is also subject to the app's own privacy rules.
- Hosting and email providers, which keep the website and our mailboxes running.
- Google, only when you click a link to Google Maps or to Elemento's Google Business Profile.
- Our accountants, when needed to issue invoices and meet clients' tax obligations.
- Public authorities, only when there is a legal obligation or a court order.
Some of these services, such as WhatsApp and Google, may store data on servers outside Brazil, under their own policies and the LGPD rules for international data transfers. Elemento does not sell, rent or give away personal data for advertising.
How long we keep it
- Contacts that didn't become projects: for as long as needed to complete the conversation and to pick it up again if you get back in touch. You can ask for deletion at any time.
- Client data: for as long as the contract lasts and, after that, for the periods required by law, such as those for tax documents.
- Website access logs: for the 6-month period set by Article 15 of the Marco Civil da Internet (Law No. 12,965/2014).
Once these periods end, the data is deleted or anonymized.
How we protect it
The website runs only over a secure connection (HTTPS), stores no passwords or payment details and has no sign-up area. The materials you send us stay in the services we use to serve you, with protected access, and only go online with your authorization, as part of the website we build for your company.
No system is completely immune. If a security incident occurs that could pose a significant risk or harm to you, Elemento will notify you and the Brazilian National Data Protection Authority (ANPD), as required by the LGPD.
Your rights
Under Article 18 of the LGPD, you may, at any time:
- confirm whether we process your data and access it;
- correct incomplete, inaccurate or outdated data;
- request the anonymization, blocking or deletion of data that is unnecessary, excessive or processed in breach of the law;
- request the portability of your data to another provider;
- request the deletion of data processed with your consent and revoke that consent;
- find out who we share your data with;
- file a complaint with the Brazilian National Data Protection Authority (ANPD).
To exercise any of them, just ask by email or on WhatsApp. We reply within the deadlines set by Article 19 of the LGPD: confirmation in simplified form immediately, and the full statement within 15 days.
